INFORMATION ON OUT-OF-COURT METHODS OF HANDLING COMPLAINTS AND PURSUING CLAIMS
Fokus Brick (fokusbrick.pl)
In line with the information obligation under the Polish Act of 23 September 2016 on out-of-court resolution of consumer disputes, Usługi Transportowe FOKUS - Mariusz Król (the “Seller”) informs that the Consumer may use out-of-court methods of handling complaints and pursuing claims related to the sales contract concluded.
1. Mediation and the arbitration court at the Trade Inspection
The Consumer is entitled to apply to the permanent consumer arbitration court operating at the competent provincial inspectorate of the Trade Inspection with a request to resolve a dispute arising from the sales contract concluded.
The Consumer is also entitled to apply to the provincial inspector of the Trade Inspection with a request to start mediation proceedings aimed at settling the dispute amicably.
Information about the procedure and a list of provincial inspectorates of the Trade Inspection are available at: https://www.uokik.gov.pl and https://www.ih.gov.pl.
2. Consumer ombudsmen
The Consumer may obtain free help in resolving a dispute with the Seller from a district (municipal) consumer ombudsman or from a social organisation whose statutory tasks include consumer protection (for example the Federacja Konsumentów and the Stowarzyszenie Konsumentów Polskich).
The Federacja Konsumentów gives free consumer advice on the helpline 801 440 220 and through the website: https://www.federacja-konsumentow.org.pl.
3. Online dispute resolution platform (ODR)
Under Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013, a Consumer living in the European Union may use the online platform for consumer dispute resolution (ODR platform), available at:
https://ec.europa.eu/consumers/odr
The ODR platform is a point of access for out-of-court resolution of disputes about contractual obligations arising from an online sales contract concluded between the Consumer and the Seller. The Seller's email address for contact in connection with dispute resolution: fokus@fokusbrick.pl.
4. Voluntary use of out-of-court dispute resolution methods
Using out-of-court methods of handling complaints and pursuing claims is voluntary. The Seller informs that, depending on the circumstances of the case, it decides individually each time whether it agrees to take part in a given out-of-court procedure. The above provisions are for information only and do not oblige the Seller to use out-of-court methods of dispute resolution.
Using out-of-court methods of handling complaints and pursuing claims does not exclude the Consumer's right to pursue claims through court proceedings.
